I. Identity and Address of the Personal Data Controller.
Macquarie Services (Mexico), S.A. de C.V., its subsidiaries, affiliates and related entities which belong to the same corporate group (hereinafter “the Data Controller”), domiciled at Pedregal 24, Level 21, Col. Molino del Rey, 11040, Mexico City, is responsible for the processing and protection of your personal data pursuant to the Federal Data Protection Act and its Regulations (hereinafter “the Law”). The Data Controller, ensures its proper use, protection and confidentiality; and therefore, hereby informs you of the following:
We process your personal data collected, for the purpose of carrying out the hiring and recruitment process, as well as for any other activity and process necessary for such process.
II. Purposes for collecting your Personal Data.
Main Purposes. The personal data will be used by the Data Controller for the following purposes, which are necessary for the hiring or recruitment process: creating your file; to implement the Data Controller’s recruitment process and to analyze your possible selection as a potential employment candidate with the Data Controller; comply with the obligations set forth in the applicable legislations; to hire third party services for purposes of your prospective employment.
Secondary Purposes. In addition, by providing your personal data, you authorize the Data Controller, to use them with survey, audit and reporting purposes, without the latter being necessary purposes or purposes that create a legal relationship between you and the Data Controller.
You grant your consent for the use of your personal data for the secondary purposes.
If you do not consent to the use of your personal data for the “secondary purposes,” or if you wish to limit the use or disclosure of your personal data, you can refuse or limit such treatment or disclosure by sending a request in writing to the following

III. Personal Data and/or Sensitive Personal Data collected.
For the purposes set forth in this privacy notice, the following personal data and/or sensitive personal data will be collected and processed: Full Name (including surnames), address, national ID, phone number, email address, date of birth, nationality, age, sex, status, economic dependents relatives, Federal Taxpayer Registration (RFC), Unique Population Registry Key (CURP), social security identification data, existence of accidents and/or previous work diseases, identification of withholdings for alimony, education information, previous employment information referred to herein as the “Personal Data,” as well as any information you provide the Data Controller in connection with your participation in the hiring or recruitment process with the Data Controller.
Additionally, it is necessary that the Data Controller, gather, manage and administer the following data, categorized by the Law as “Sensitive Data,” in order to face any disease prevention: existence of serious diseases, existence of chronic non-communicable diseases (arterial hypertension, pulmonary, renal failure, lupus, cancer, diabetes, mellitus, obesity, liver or metabolic failure, heart disease), existence of any disease or pharmacological treatment that generates suppression of the immune system, etc.
Likewise, the Data Controller will collect Sensitive or Financial Personal Data1 such as: salary history, criminal history; (referred to herein as “Sensitive or Financial Personal Data”), through either of the following forms: (i) when the you directly provide such data to the personnel; (ii) when the Data Controller obtains such data indirectly; and/or (iii) when the Data Controller obtains such data from the permitted sources in accordance to Mexican legislation.
The personal economic/financial and sensitive data collected by the Data Controller shall be processed for the fulfillment of the purposes set forth in this Privacy Notice, for which the Data Controller requires your express consent for the processing of such data, pursuant to Articles 8 and 9 of the Law.
The Data Controller, through its People and Culture team and the personnel administration area, is responsible for the treatment of your Personal Data and Sensitive or Financial Data, and is obligated to comply with the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility protected by the Law. For this reason, pursuant Articles 13 and 14 of the Law, the Data Controller, undertakes to keep strict confidentiality of your personal data, as well as to maintain administrative, technical and physical security measures permitted to protect them against any damage, loss, alteration, access or unauthorized treatment.
IV. Personal Data Transfers
Your Personal Data and/or Sensitive or Financial Personal Data may be transferred and processed by third parties other than the Data Controller, such as: the subsidiaries, affiliates or parents of the Data Controller, with the purpose of safeguarding such information, for registration and deregistration control; (ii) unrelated third parties (service providers), with the exclusive purpose of assisting the Data Controller with the compliance of its obligation under applicable legislation; (iii) when required by a court order issued by any administrative, judicial or government authority of any sort, either Mexican or foreign; (iv) unrelated third parties subcontracted to process your information on behalf and under instructions of the Data Controller, such third parties will maintain the personal data under strict confidentiality, further recognizing the terms and conditions set forth herein, and who undertake to comply with this Privacy Notice.
By signing this Privacy Notice I hereby grant my consent for the transfer of my Personal Data and/or Sensitive or Financial Personal Data pursuant to the terms of this Privacy Notice.
V. Right to Access, Rectification, Cancelation and Opposition (ARCO), Consent Revocation and Limit to the use or disclosure of your Personal Data.
You have the right to access, rectify and cancel your personal data, oppose to the processing of such data, limit its use or disclosure, or revoke the consent that you have granted us to process your data (these rights are known as “ARCO” rights), by emailing a request to: privacy@macquarie.com.
Your request should contain at least the minimum requirements set forth in Article 29 of the Law, and will be processed pursuant to such legislation.
VI. Automatic Means to Collect Personal Data.
The Data Controller uses its own and third party cookies with analytical and marketing purposes in order to improve your experience of navigation on its website. If you navigate the website without changing the configuration of cookies, it will be deemed that you accept its installation and use pursuant to the Data Controller’s cookies policy. However, if you wish, you can change the configuration of cookies at any time.
The Data Controller has sufficient security measures for the protection, confidentiality and assurance of your personal data to restrict access to non-authorized people. Likewise, the Data Controller’s employees, representatives, subcontractors, and consultants, and/or third parties involved in any stage of processing of your personal data will keep confidentiality with respect to these, an obligation that shall continue until the end of the relationship between such persons.
This Privacy Notice might be changed, modified or updated due to new legal requirements; the Data Controller’s own needs based on the services it offers; the Data Controller’s privacy practices; or for other reasons. The Data Controller will keep you informed of any changes to this privacy notice through a notice sent to the latest e-mail address that you have provided.
- Sensitive personal data is defined by the Law as “the personal data that affects the most intimate sphere of the data subject, or which improper use may give rise to discrimination or entails a serious risk for the latter. In particular, the data that may reveal the following aspects is considered sensitive: racial or ethnic origin; current or future health condition; genetic information; religious, philosophic and moral beliefs; union membership; political views; and sexual preferences.” Do note that criminal records or background and health issues are sensitive personal data.
