At Macquarie, we want our people to feel supported in their career journey, and that starts with the recruitment process. When you share your information with us, we want you to feel confident that you understand how we will collect, use and store it.

As the information that you share will be different depending on where you are in your recruitment journey, the way we manage and store your data may also change. Your information

There are many ways you could share your information with us during the recruitment process, from registering your interest in Macquarie events or employment opportunities, submitting an application or CV, taking part in a video or in-person interview, or even subscribing to content about Macquarie.

The information you supply may be limited to your contact details, or could include other additional information, such as your application data, right to work status and educational history. It may also include other personal information that you choose to provide (such as gender identity or information about adjustments or accommodations you may be seeking). We refer to all of this data as 'your information'.

Collection, use and disclosure

Macquarie respects your privacy and security and will only collect, use and disclose your information where it is necessary to administer the recruitment process, send you the updates and information you’ve subscribed to such as Macquarie content or events, or where Macquarie has another legitimate interest in processing your information. These are some practical examples of legitimate purposes:

to assess your application for a role (including conducting psychometric assessment and reference checks);
to communicate with you in relation to your application or other suitable roles with Macquarie;
to comply with legal and / or regulatory obligations;
to prepare internal reporting; and
to monitor and review Macquarie's recruitment practices to make sure they meet candidate expectations and are working as expected.

If you’re successful in securing a role, then your information will also be collected, used and disclosed as needed in relation to your employment or engagement with Macquarie.

In carrying out the above activities, your information may be controlled and processed by Macquarie staff as well as those we work with. This includes Macquarie's officers, affiliates, agents, contractors and service providers worldwide.

Where it is necessary for your information to be transferred to other locations, Macquarie will take steps to protect your information against misuse or loss and will comply with any relevant local law requirements.

Storage

If you apply for a role and your application is unsuccessful, Macquarie may retain your information on file for three years, subject to any local laws or regulatory expectations that are applicable in the location for that role. Macquarie may use this information to let you know about other roles that could be of interest to you. If you’d prefer Macquarie not to retain your information on file for these purposes, please get in touch to let us know.

If you decide to apply for another role while your information is on file, the storage period will re-start from the date of your most recent application to Macquarie. When the relevant storage period comes to an end, Macquarie will make best efforts to delete, anonymise or put your information ‘beyond use’ within three months. If your application is successful, Macquarie will retain your information as part of your employment records.

If you’ve subscribed to updates on roles, events or Macquarie content but haven’t applied for a role, then your information will be retained for two years; you will have the opportunity to opt out from receiving updates at any time. We’ll check in with you before that two-year period expires to see if you’d like to continue to receive updates. If we don’t hear from you, we’ll assume you’re no longer interested in receiving updates and will make best efforts to delete, anonymise or put your information ‘beyond use’ within three months.

If you are unsuccessful in applying for a role with Macquarie while you’re subscribed to updates, we will retain your information based on whichever retention period expires last out of the relevant retention period for an unsuccessful applicant and the relevant retention period for a subscriber.

If you secure employment with Macquarie while you’re subscribed to updates, Macquarie will retain your information as part of your employment records and you’ll continue to receive updates until you opt-out.

Your data, your choice

If, for any reason, you’re not comfortable with your information being used, collected, stored or disclosed in the ways described in this policy, please do not provide your information to Macquarie - you are not required by law to submit your information. Please note, however, that Macquarie may not be able to accept or process your application or requests if the necessary information is not supplied.

You may request access to your information (and the correction of incorrect information) at any time by contacting Macquarie at privacy@macquarie.com. If you are in the European Economic Area or the UK, you may also request that your information be transferred to another controller. Macquarie will address any such requests in accordance with any relevant obligations set out in the EU General Data Protection Regulation (GDPR).

If you are concerned about the way in which Macquarie has processed or used your personal information, you have the right to lodge a complaint with the Information Commissioner or other applicable regulatory authority in your location, if available.

This Notice describes the personal information Macquarie Group collects from and about prospective employees who reside in California. We want you to understand the categories of personal information we collect and the purposes for which the information will be used. We do not sell, share or disclose to third parties any personal information we collect from prospective employees.

If you have visited our public website, we have shared your IP address, the URL you came from, and your interaction with the website with analytics providers for their use in cross-context behavioral advertising across multiple websites. About this Addendum

This China Addendum (“Addendum”) is a local supplement of the Careers Privacy Policy of Macquarie Group (“Careers Privacy Policy”) and intends to highlight the specific principles and rules that Macquarie (which includes Macquarie Investment Advisory (Beijing) Co. Ltd., Macquarie Investment Advisory (Beijing) Co. Ltd., Shanghai Branch, Macquarie Investment Consulting (Shanghai) Co. Ltd., Macquarie Commodities Trading (Shanghai) Co. Ltd., Macquarie Securities (Australia) Limited Shanghai Representative Office, and their branches, subsidiaries and related entities) (the “Company” or “we”) follows when processing your personal information during the recruitment process in accordance with the applicable laws of the People’s Republic of China (“China”, and for the purpose of this Addendum only, “China” refers to the mainland of the People’s Republic of China, excluding Hong Kong Special Administrative Region, Macau Administrative Region and Taiwan region).

Before you submit your resume and/or job application form to us, please read this Addendum carefully and understand the information provided herein. Please indicate your consent and separate consent to the specific processing activities described herein by checking the appropriate box and signing at the end of this Addendum.

Sensitive personal information

"Sensitive personal information" is subject to special protection under Chinese law. Sensitive personal information means the personal information that, once disclosed or illegally used, is easy to infringe upon the personal dignity of natural persons or endanger the safety of human life and property, including such information as biometric identification, religious belief, specific identity, medical treatment and health, financial accounts, and whereabouts, as well as personal information of minors under the age of 14.

We need to process your sensitive personal information (including your identification document information, criminal records and information on civil proceedings to consider your job application and decide whether to enter into an employment contract with you. Without such information, we may not be able to proceed with your application.

We will not process your sensitive personal information unless we have obtained your separate consent or are otherwise required by applicable laws and regulations. We take strict measures to protect your sensitive personal information.

Transferring your personal information outside of China

As Macquarie adopts a unified global human resources management framework, in order to consider and process your application, we need to provide your personal information to recipients located outside of China, including certain overseas affiliates of Macquarie group located outside of China.

In order to transfer your personal information to the overseas recipients, we will obtain your separate consent, and will ensure that the overseas recipients' processing of personal information meets the personal information protection standards prescribed by the applicable laws and regulations.

Names and contact details of the overseas recipients, the purposes and manners of processing, and the types of personal information to be transferred are set out in the below table.

Your rights

You are entitled to a series of legal rights with respect to your personal information held by us, including the rights to:

be informed of the processing of your personal information;
withdraw your consent to process your personal information at any time. Your withdrawal of your consent will not affect the validity of the personal information processing activities we have conducted based on your consent prior to withdrawal. However, please note that even if you withdraw your consent, we may still have the right to process your personal information based on another legal basis;
access your personal information and obtain a copy of it;
If you request the transfer of your personal information to a designated personal information processor, we will provide a means of transfer subject to the conditions prescribed by the applicable laws and regulations;
request correction and/or supplement of inaccurate or incomplete personal information;
request us to delete your personal information under certain circumstances. However, please note that we still have the right to retain your personal information even if you request us to delete it prior to the expiry of the retention period prescribed by the applicable laws and regulations;
stop or restrict our processing of your personal information under certain circumstances. However, please note that we are legally entitled to refuse your request under certain circumstances;
request an explanation of our personal information processing rules;
request explanation and refuse to be subject to a decision based solely on automated processing when we make a decision by an automated decision-making mode that has a material impact on your rights and interests; and
complain to and report illegal personal information processing activities to the applicable personal information protection authority.

I. Identity and Address of the Personal Data Controller.

Macquarie Services (Mexico), S.A. de C.V., its subsidiaries, affiliates and related entities which belong to the same corporate group (hereinafter “the Data Controller”), domiciled at Pedregal 24, Level 21, Col. Molino del Rey, 11040, Mexico City, is responsible for the processing and protection of your personal data pursuant to the Federal Data Protection Act and its Regulations (hereinafter “the Law”). The Data Controller, ensures its proper use, protection and confidentiality; and therefore, hereby informs you of the following:

We process your personal data collected, for the purpose of carrying out the hiring and recruitment process, as well as for any other activity and process necessary for such process.

II. Purposes for collecting your Personal Data.

Main Purposes. The personal data will be used by the Data Controller for the following purposes, which are necessary for the hiring or recruitment process: creating your file; to implement the Data Controller’s recruitment process and to analyze your possible selection as a potential employment candidate with the Data Controller; comply with the obligations set forth in the applicable legislations; to hire third party services for purposes of your prospective employment.

Secondary Purposes. In addition, by providing your personal data, you authorize the Data Controller, to use them with survey, audit and reporting purposes, without the latter being necessary purposes or purposes that create a legal relationship between you and the Data Controller.

You grant your consent for the use of your personal data for the secondary purposes.

If you do not consent to the use of your personal data for the “secondary purposes,” or if you wish to limit the use or disclosure of your personal data, you can refuse or limit such treatment or disclosure by sending a request in writing to the following

III. Personal Data and/or Sensitive Personal Data collected.

For the purposes set forth in this privacy notice, the following personal data and/or sensitive personal data will be collected and processed: Full Name (including surnames), address, national ID, phone number, email address, date of birth, nationality, age, sex, status, economic dependents relatives, Federal Taxpayer Registration (RFC), Unique Population Registry Key (CURP), social security identification data, existence of accidents and/or previous work diseases, identification of withholdings for alimony, education information, previous employment information referred to herein as the “Personal Data,” as well as any information you provide the Data Controller in connection with your participation in the hiring or recruitment process with the Data Controller.

Additionally, it is necessary that the Data Controller, gather, manage and administer the following data, categorized by the Law as “Sensitive Data,” in order to face any disease prevention: existence of serious diseases, existence of chronic non-communicable diseases (arterial hypertension, pulmonary, renal failure, lupus, cancer, diabetes, mellitus, obesity, liver or metabolic failure, heart disease), existence of any disease or pharmacological treatment that generates suppression of the immune system, etc.

Likewise, the Data Controller will collect Sensitive or Financial Personal Data¹ such as: salary history, criminal history; (referred to herein as “Sensitive or Financial Personal Data”), through either of the following forms: (i) when the you directly provide such data to the personnel; (ii) when the Data Controller obtains such data indirectly; and/or (iii) when the Data Controller obtains such data from the permitted sources in accordance to Mexican legislation.

The personal economic/financial and sensitive data collected by the Data Controller shall be processed for the fulfillment of the purposes set forth in this Privacy Notice, for which the Data Controller requires your express consent for the processing of such data, pursuant to Articles 8 and 9 of the Law.

The Data Controller, through its People and Culture team and the personnel administration area, is responsible for the treatment of your Personal Data and Sensitive or Financial Data, and is obligated to comply with the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility protected by the Law. For this reason, pursuant Articles 13 and 14 of the Law, the Data Controller, undertakes to keep strict confidentiality of your personal data, as well as to maintain administrative, technical and physical security measures permitted to protect them against any damage, loss, alteration, access or unauthorized treatment.

IV. Personal Data Transfers

Your Personal Data and/or Sensitive or Financial Personal Data may be transferred and processed by third parties other than the Data Controller, such as: the subsidiaries, affiliates or parents of the Data Controller, with the purpose of safeguarding such information, for registration and deregistration control; (ii) unrelated third parties (service providers), with the exclusive purpose of assisting the Data Controller with the compliance of its obligation under applicable legislation; (iii) when required by a court order issued by any administrative, judicial or government authority of any sort, either Mexican or foreign; (iv) unrelated third parties subcontracted to process your information on behalf and under instructions of the Data Controller, such third parties will maintain the personal data under strict confidentiality, further recognizing the terms and conditions set forth herein, and who undertake to comply with this Privacy Notice.

By signing this Privacy Notice I hereby grant my consent for the transfer of my Personal Data and/or Sensitive or Financial Personal Data pursuant to the terms of this Privacy Notice.

V. Right to Access, Rectification, Cancelation and Opposition (ARCO), Consent Revocation and Limit to the use or disclosure of your Personal Data.

You have the right to access, rectify and cancel your personal data, oppose to the processing of such data, limit its use or disclosure, or revoke the consent that you have granted us to process your data (these rights are known as “ARCO” rights), by emailing a request to: privacy@macquarie.com.

Your request should contain at least the minimum requirements set forth in Article 29 of the Law, and will be processed pursuant to such legislation.

VI. Automatic Means to Collect Personal Data.

The Data Controller uses its own and third party cookies with analytical and marketing purposes in order to improve your experience of navigation on its website. If you navigate the website without changing the configuration of cookies, it will be deemed that you accept its installation and use pursuant to the Data Controller’s cookies policy. However, if you wish, you can change the configuration of cookies at any time.

The Data Controller has sufficient security measures for the protection, confidentiality and assurance of your personal data to restrict access to non-authorized people. Likewise, the Data Controller’s employees, representatives, subcontractors, and consultants, and/or third parties involved in any stage of processing of your personal data will keep confidentiality with respect to these, an obligation that shall continue until the end of the relationship between such persons.

This Privacy Notice might be changed, modified or updated due to new legal requirements; the Data Controller’s own needs based on the services it offers; the Data Controller’s privacy practices; or for other reasons. The Data Controller will keep you informed of any changes to this privacy notice through a notice sent to the latest e-mail address that you have provided.

Sensitive personal data is defined by the Law as “the personal data that affects the most intimate sphere of the data subject, or which improper use may give rise to discrimination or entails a serious risk for the latter. In particular, the data that may reveal the following aspects is considered sensitive: racial or ethnic origin; current or future health condition; genetic information; religious, philosophic and moral beliefs; union membership; political views; and sexual preferences.” Do note that criminal records or background and health issues are sensitive personal data.
